The Osun State chapter of the All Progressives Congress (APC) has taken legal action against Governor Ademola Adeleke of the Peoples Democratic Party (PDP) in the state high court. This move comes in response to Governor Adeleke's self-proclamation as the commissioner for works in the state, with his deputy, Kola Adewusi, declared as the commissioner for sports and special needs.
The APC, being the opposition party in the state, did not take this development lightly. They filed a suit with the reference number HOS/03/79/2023, naming the governor, his deputy, the state's attorney general and commissioner for justice, and the state's house of assembly as the respondents in the case.
The primary issues raised by the APC in their suit revolve around the interpretation of constitutional provisions. Firstly, they are questioning whether a state governor, particularly the 1st defendant (Governor Adeleke), can hold any other executive office while in office as the governor, as stipulated by Section 183 of the Constitution of the Federal Republic of Nigeria, 1999 (as altered). Secondly, they are challenging the validity of a person's appointment as a Commissioner of the State Government if the nominee's name is not forwarded to and received by the State's House of Assembly for confirmation, as outlined in Section 192(2) and (5) of the Constitution of the Federal Republic of Nigeria, 1999 (as altered).
The case is now before the state high court, where legal arguments and evidence will be presented to determine the validity of Governor Adeleke's self-declaration as the commissioner for works and the appointment of his deputy as the commissioner for sports and special needs.
