The National Industrial Court of Nigeria, sitting in Benin City, Edo State, has declared that Governor Godwin Obaseki's directive of June 8, 2022, suspending trade unions' activities in tertiary institutions in the state, is unconstitutional, illegal, null and void.
The court's decision was in response to a suit brought by the Academic Staff Union of Universities, Ambrose Alli University chapter, challenging the directive.
The court also granted the union's request for a perpetual injunction restraining the defendants, including the state government, from interfering with or intermeddling in the claimants' exercise of their fundamental right to engage in trade union activities.
The ASUU, AAU chapter, expressed satisfaction with the judgment, describing it as a victory for constitutionalism, the rule of law, and due process.
